Terms and Conditions

1. Overview

This website is operated by leesea (“we”, “us”, “our”). By accessing or purchasing from our store, you agree to be bound by these Terms & Conditions.

These Terms apply to all users of the site, including browsers, customers, and merchants.

2. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law (ACL).

Under the ACL, consumers are entitled to certain guarantees, including that products are:

  • of acceptable quality
  • fit for purpose
  • as described

If a product fails to meet these guarantees, you may be entitled to a repair, replacement, or refund.

3. Products

We sell:

  • Swimwear
  • Vinyl records

We make every effort to display products accurately, however colours and images may vary slightly due to screen settings.

Vinyl records may include minor variations in packaging or pressing as they are physical media products.

4. Pricing & Payments

All prices are listed in AUD and include GST (where applicable).

We reserve the right to change prices at any time without notice.

Payment must be received in full before orders are dispatched.

5. Shipping

We aim to dispatch orders promptly, however shipping timeframes are estimates only.

We are not responsible for delays caused by:

  • postal carriers
  • customs
  • external factors outside our control

Risk passes to you once the item has been shipped.

6. Returns & Exchanges (Change of Mind)

We offer exchange or a store credit for change of mind, size, or style subject to the following:

  • Requests must be made within 7 days of delivery
  • Items must be unworn, unused, with tags and hygiene liners intact
  • Items must be returned in original condition

Please note: Under Australian Consumer Law, businesses are not required to provide refunds for change of mind, but must honour their own stated policy

7. Faulty or Incorrect Items

If your item is faulty, damaged, or not as described, please contact us at hello@leesea.com.au

Under Australian Consumer Law:

  • You are entitled to a refund or replacement for major faults
  • For minor faults, we may offer a repair, replacement, or refund

We will cover reasonable return shipping costs for confirmed faulty items.

We do not require items to be returned in original packaging to assess a fault, but proof of purchase is required.

8. Swimwear Hygiene Policy

For hygiene reasons:

  • Swimwear must be tried on over underwear
  • Returns will not be accepted if hygiene liners are removed or items are worn

This does not affect your rights under the Australian Consumer Law.

9. Vinyl Record Policy

Due to the nature of vinyl records:

  • We do not accept returns for minor cosmetic imperfections that do not affect playback
  • We do not accept returns for change of mind on opened vinyl

However, if a vinyl is:

  • faulty
  • warped
  • unplayable

you are entitled to a remedy under Australian Consumer Law.

10. Order Cancellations

We reserve the right to cancel or refuse any order at our discretion, including where:

  • products are unavailable
  • there is an error in pricing or description

If your order is cancelled, you will receive a full refund.

11. Intellectual Property

All content on this site, including images, branding, and designs, is owned by leesea and may not be used without permission.

12. Limitation of Liability

To the extent permitted by law, we are not liable for:

  • indirect or consequential loss
  • delays outside our control

Nothing in this clause excludes your rights under the Australian Consumer Law.

13. Privacy

Your personal information is handled in accordance with our Privacy Policy.

14. Changes to Terms

We reserve the right to update these Terms at any time. Changes will take effect immediately upon publication.
